Terms of Use for the Ritsumeikan University Inter-Campus Shuttle Bus App and Shuttle Bus

These Terms of Use (hereinafter referred to as the “Terms”) set forth the conditions for using the Inter-Campus Shuttle Bus App provided by Ritsumeikan University (hereinafter referred to as the “University”) and the necessary matters concerning the use of the Inter-Campus Shuttle Bus (hereinafter referred to as the “Shuttle Bus”). Users must agree to these Terms in order to use the Service.

Article 1 (Applicability)

These Terms shall apply to all matters concerning the use of the Service and the Shuttle Bus between the University and students, faculty, staff, and other persons affiliated with the University who are authorized by the University to use the Service (hereinafter referred to as the “Users”).

2. In addition to these Terms, the University may post rules, precautions, and other matters concerning the use of the Service and the Shuttle Bus on the Service (hereinafter referred to as “Individual Provisions”). In such cases, the Individual Provisions shall constitute a part of these Terms.

3. If these Terms conflict with the Individual Provisions, the Individual Provisions shall take precedence unless otherwise specified in the Individual Provisions.

4. When using services provided by other operators through the Service, Users shall comply not only with these Terms but also with the terms and conditions established by the operators providing such services.

Article 2 (Service Content)

The Service provides the following functions:

• (1) Seat reservations for the Shuttle Bus
• (2) Fare payment for the Shuttle Bus
• (3) Confirmation of the operating status of the Shuttle Bus
• (4) Inquiries regarding lost items on the Shuttle Bus

Article 3 (User Registration)

The Service may be used by students, faculty, staff, and other persons affiliated with the University who agree to these Terms, apply for user registration by the method specified by the University, and receive approval from the University.

2. If the University determines that a User falls under any of the following items, the University may restrict or suspend the User’s use of the Service without prior notice:

• (1) The User has registered false information.
• (2) It is found that the User is not affiliated with the University.
• (3) There is unauthorized use or a risk of unauthorized use.
• (4) The University otherwise determines that the User’s use is inappropriate.

Article 4 (Account Management)

Users shall appropriately manage their account information for the Service, including their email address, password, LINE account, and other relevant information, at their own responsibility.

2. The University shall bear no responsibility for any damage arising from insufficient account management, use by a third party, or other similar circumstances.

Article 5 (Fares and Payment)

Use of the Service is free of charge; however, a fare is required to use the Shuttle Bus. Users shall pay the fare displayed on the Service by the method specified by the University.

2. Users shall be obligated to pay the fare when a reservation is completed.

3. Fares already paid shall not be refunded if the Shuttle Bus is not used due to cancellation for the User’s own convenience or for any other reason attributable to the User. However, the handling of cases in which the Shuttle Bus cannot be used due to suspension of operation or other reasons attributable to the University or the bus operating company shall be in accordance with the Individual Provisions or a method separately specified by the University.

Article 6 (Reservations and Cancellations)

Users may reserve seats on the Shuttle Bus through the Service.

2. The conditions for completion, changes, and cancellation of reservations shall be in accordance with the information displayed on the Service.

3. Even if a User does not complete the cancellation procedure after making a reservation and does not use the Shuttle Bus, the fare for the relevant reservation shall not be refunded.

4. Reservations may be changed or cancelled even after completion due to circumstances affecting the University, the bus operating company, or other related business operators.

5. The operation of the Shuttle Bus is provided by the bus operating company.

Article 7 (Boarding Restrictions Due to Full Capacity, etc.)

The Shuttle Bus has a fixed capacity, and even if a reservation has been completed, Users may not be able to board due to operational or safety reasons.

2. The handling of fares in cases where a User is unable to board due to full capacity or other reasons not attributable to the User shall be in accordance with the Individual Provisions or a method separately specified by the University.

Article 8 (Prohibited Acts)

Users shall not engage in any of the following acts when using the Service:

• (1) Acts that violate laws, regulations, or University rules
• (2) Use for fraudulent or unauthorized purposes
• (3) Impersonating another person
• (4) Unauthorized access to the system or attempts thereof
• (5) Acts that interfere with the operation of the Service
• (6) Acts that prevent fair use by other Users, such as excessive reservations or repeated cancellations
• (7) Any other acts deemed inappropriate by the University

Article 9 (Prohibition of Fraudulent Boarding)

Only the User who made the reservation through the Service may use the Shuttle Bus, and the User shall not allow any third party to use the reservation.

2. Boarding using a reservation made under another person’s name, lending or transferring an account, or any other similar acts shall be deemed fraudulent boarding.

3. If fraudulent boarding is confirmed, the University may suspend the relevant User’s use of the Service, invalidate the relevant reservation, or take other necessary measures.

4. If the University determines that the fraudulent boarding is malicious, the User may be subject to disciplinary action based on the Ritsumeikan University Regulations or other University rules and regulations.

Article 10 (Matters to Be Observed Inside the Bus and During Boarding and Alighting)

Users shall observe the following matters when using the Shuttle Bus:

• (1) Follow the instructions of the driver or staff inside the bus.
• (2) Do not engage in acts that interfere with safe operation, such as walking around while the bus is moving or sitting in a seat other than the designated seat.
• (3) Do not engage in acts that cause inconvenience to other passengers, such as speaking loudly, making noise, or using intimidating language or behavior.
• (4) Do not bring dangerous items or any other items deemed inappropriate into the bus.
• (5) Do not board or alight at any location other than the designated bus stops.

2. If a User is found to have engaged in any act that violates the preceding paragraph, the University or the bus operating company may request the relevant User to alight from the bus.

Article 11 (Handling in the Event of Accidents, etc.)

In the event of an accident, injury, damage to a User’s belongings, or other similar incident during the operation of the Shuttle Bus, liability shall be determined in accordance with the conditions of carriage established by the bus operating company and applicable laws and regulations, except in cases caused by the willful misconduct or gross negligence of the University.

2. The University shall bear no responsibility for any damage caused by a User’s negligence, acts in violation of these Terms, or failure to follow the instructions of the driver or staff.

3. In the event of an accident or other incident, the University will take necessary measures within a reasonable scope, such as confirming the situation and contacting relevant organizations; however, the University does not guarantee individual compensation for damages.

Article 12 (Application of Conditions of Carriage, etc.)

In addition to these Terms, the conditions of carriage and in-vehicle rules established by the bus operating company (hereinafter referred to as the “Conditions of Carriage, etc.”) shall apply to the operation of the Shuttle Bus.

2. If there is any inconsistency between these Terms and the Conditions of Carriage, etc. set forth in the preceding paragraph, the Conditions of Carriage, etc. shall prevail with respect to matters concerning bus operation, safety management, and accident response.

3. Users shall be deemed to have agreed in advance to the Conditions of Carriage, etc. when using the Shuttle Bus.

Article 13 (Measures by Drivers and Staff)

In order to ensure the safe and smooth operation of the Shuttle Bus, drivers or staff may take the following measures:

• (1) Giving warnings or instructions to Users who violate these Terms or the Conditions of Carriage, etc.
• (2) Refusing boarding or requesting a User to alight from the bus when deemed necessary for safety reasons.
• (3) Suspending or changing operation in the event of an emergency.

2. The measures set forth in the preceding paragraph shall be taken with safety as the highest priority, and Users shall comply with such measures.

3. Even if a User incurs damage as a result of the measures set forth in the preceding two paragraphs, the University shall bear no responsibility, except in cases caused by the willful misconduct or gross negligence of the University.

Article 14 (Suspension of Use, etc.)

If a User violates these Terms, the University may give a notice, issue a warning, suspend use of the Service, or take other necessary measures depending on the severity of the violation.

2. In the event of unauthorized use or a risk thereof, the University may immediately take necessary measures without prior notice.

Article 15 (Suspension, Modification, and Termination of the Service)

The University may suspend or interrupt all or part of the Service in any of the following cases:

• (1) System maintenance or inspection
• (2) Communication failures, system failures, or other similar issues
• (3) Force majeure such as disasters
• (4) Any other cases where the University determines that suspension or interruption is necessary

2. The University shall bear no responsibility for any disadvantage or damage incurred by Users due to the suspension or interruption of the Service.

3. The University may modify or terminate the content of the Service. In such cases, the University shall bear no responsibility for any disadvantage or damage incurred by Users due to the modification or termination of the Service.

Article 16 (Disclaimer Regarding Traffic and Operation)

The University shall bear no responsibility for any damage incurred by Users as a result of delays, suspension of operation, changes, or other disruptions to the Shuttle Bus caused by traffic conditions, weather, accidents, vehicle trouble, or any other reason.

2. The operation of the Shuttle Bus shall prioritize safety above all else and may be changed depending on the circumstances.

Article 17 (Third-Party Services)

The Service may integrate with LINE or other third-party services.

2. The University shall bear no responsibility if the Service becomes unavailable due to failures, changes in specifications, or other circumstances related to such third-party services.

Article 18 (Intellectual Property Rights)

Intellectual property rights related to the Service shall belong to the University or the legitimate rights holders.

Article 19 (Disclaimer of Warranty and Limitation of Liability)

The University shall endeavor to operate the Service appropriately but does not guarantee the completeness, accuracy, or other qualities of the Service.

2. If a User incurs damage in connection with the use of the Service, the University’s liability shall be limited to the amount equivalent to the fare paid by the User through the Service in the relevant fiscal year, provided that such damage is due to reasons attributable to the University.

3. The University shall bear no responsibility for indirect damages, special damages, lost profits, or other similar damages incurred by Users in connection with the use of the Service.

Article 20 (User Information)

When registering for the Service, Users are required to register personal information, including their name, email address, and student ID number. The registered personal information will be used for the management of the Service and will not be provided to third parties.

2. The University shall appropriately manage personal information and handle it in accordance with The Ritsumeikan Trust Privacy Policy and The Ritsumeikan Trust Personal Information Protection Regulations.

3. The University may use personal information as statistical information after processing it into a form that does not identify individuals.

4. Due to operational reasons related to the Service, the personal information registered by Users will be deleted at the end of the fiscal year. Users who wish to use the Service in the following fiscal year must complete the registration procedure again.

5. Users’ reservation information, usage history, and other data from the previous fiscal year will be deleted at the end of the fiscal year.

6. The University shall bear no responsibility for any damage incurred by Users as a result of the deletion set forth in the preceding two paragraphs.

Article 21 (Modification of the Terms)

The University may modify these Terms as necessary.

2. When modifying these Terms, the University shall post notice of the modification in advance within the Service.

Article 22 (Notifications)

Notifications concerning the Service shall be made within the Service or sent to the registered contact information.

Article 23 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan. The court having jurisdiction over the location of the University’s principal office shall be the exclusive agreed court of jurisdiction in the first instance.

Article 24 (Contact Information)

Inquiries regarding the Service and questions regarding its use shall be accepted by the following office:
